The Fair Banking Officer will fill an officer-level position responsible for administering and coordinating all aspects of three Enterprise-wide Compliance Programs: the Fair Lending Compliance Program; the Fair Banking Program; and the Consumer Complaint Management Program. The Fair Banking Officer will lead a team of Compliance professionals who provide second line oversight on matters related to the Equal Credit Opportunity Act, Fair Housing Act and state fair lending laws (fair lending laws), Unfair Deceptive or Abusive Acts or Practices (UDAAP), and consumer complaint management. The Fair Banking Officer chairs the Bank’s Fair Banking Sub-Committee of the Compliance Committee and provides regular reporting to senior management and governance committees related to UDAAP, Fair Lending, complaint management and other fair banking indicators.

Responsibilities:
Maintain a proficient level of knowledge of the requirements of various banking laws, regulations and regulatory guidelines, including but not limited to: Regulation B – Equal Credit Opportunity Act (ECOA), Fair Housing Act, Unfair, Deceptive, or Abusive Acts or Practices (UDAAP), Interagency Fair Lending Guidelines, Regulation C – Home Mortgage Disclosure Act (HMDA).
Direct the Fair Lending Compliance Analyst in performing fair lending statistical analysis, monitoring, and file reviews. Leverages the analysis and work of the Fair Lending Compliance Analyst to develop a clear understanding of potential fair lending risk factors, to advise on mitigation of associated risks, and to help determine appropriate corrective action where necessary.
Oversee and enhance the Bank’s Compliance Programs for Fair Lending, Fair Banking and Complaint Management and associated policy documents. Chair the Fair Banking Sub-Committee of the Compliance Committee.
Provide guidance and comprehensive consideration of fair lending and fair banking requirements in relation to: new product and service development; certain business strategic initiatives; incentive compensation; business unit policies and procedures; marketing and advertising practices; and supplier management.
Manage the process of conducting comprehensive fair lending and UDAAP risk assessments to effectively evaluate enterprise-wide fair lending and UDAAP risks.
Manage change management processes in response to industry fair lending, UDAAP and/or Complaint Management enforcement actions, regulatory guidance, and industry fair lending litigation.
Oversee Compliance monitoring of complaint activity for potential fair lending, UDAAP, consumer impact, or other regulatory compliance issues, work with management to identify root causes and adjust processes as warranted.
Lead the development of periodic reporting to senior management and governance committees related to UDAAP, Fair Lending, complaint management and other fair banking indicators.
Interact professionally with regulatory agency personnel, such as answering examination information requests, addressing examination findings, and effectively explaining Fair Banking Compliance processes.
Monitor and advise on corrective action to violations, deficiencies and potential regulatory actions such as Matters Requiring Attention (MRA), third-party reviews and other regulatory communications until satisfactory resolution is obtained.
Oversee the review of complaint data, trending and reporting to senior management and the Board of Directors.
Direct a team of compliance professionals supporting the Fair Banking Officer role. Evaluate employee performance, including performance evaluations, mentoring and coaching.
Promote a strong Fair Banking compliance culture throughout the Bank by positively interacting with business unit management and senior management.















Position Requirements:





Bachelor’s degree required; graduate degree preferred (particularly in law)
Minimum 5 years of experience, preferably working in the financial industry (such as regulatory compliance manager, lawyer with a focus on regulatory compliance, federal examiner (CFPB, OCC, FDIC, OTS), regulatory consultant, consumer banking audit)
Significant knowledge of laws, regulations and issues relating to fair and responsible banking including: HMDA, ECOA, FHA, UDAAP and other matters
Experience with OCC, CFPB or other large bank examinations
Compliance Regulatory Management Certification (CRCM) is preferred, but not immediately required
Outstanding communication skills (both oral and written), with the ability to communicate clearly with constituents at all levels
Ability to negotiate effectively using diplomacy and tact to resolve difficult issues while maintaining a high degree of professionalism
Ability to identify and resolve problems with critical thinking
Dedication to integrity, producing high quality results, and meeting deadlines
Ability to lead, manage, and direct staff
Strong project management and organizational skills
